Man Sues Texas Officer for Injuries During Diabetic Emergency
Sept. 02--A Travis County man is suing a Pflugerville police officer, the city of Pflugerville and University Medical Center Brackenridge for injuries he says he sustained after the officer dropped him off at the hospital.
The lawsuit, filed in U.S. district court on Tuesday, claims that Jose Moran was struck by a cement truck after officer Tyler Summers left him outside the emergency room of UMC Brackenridge and failed to properly check him in.
Moran struck a light pole in 2013 while was suffering a diabetic emergency, the suit says. Police were called and, when Summers arrived, he suspected that Moran had been driving while intoxicated, handcuffed him and took him to the Travis County Jail.
As Moran was being booked, the medical staff noticed his blood sugar level was extremely high and asked Summers to take him to an emergency room for further care, the document says.
Summers dropped Moran outside UMC Brackenridge and failed to "secure medical care for Moran," the suit says.
"As a direct and proximate result of Summers' failure to check Moran in to the hospital, in his confused and unsteady state, Moran was not triaged and wandered away from the emergency room, and was struck by a cement truck, causing significant and permanent bodily injuries," the suit claims.
Alternatively, the hospital's staff failed to monitor or triage Moran, the suit says.
In his lawsuit, Moran claims Summers, the city of Pflugerville and the hospital staff were negligent and blames them for his injuries.
The lawsuit seeks damages for physical and mental pain, attorney fees and relief for past and future impairment and disfigurement.
